Limitation of Liability
This Limitation of Liability ("Limitation") applies solely to your free use of the Site and does not extend to any purchase of products or services from Harmony Haven.
Your use of the Site is entirely at your own risk. Harmony Haven’s sole obligation to you is to provide the Site "as is." Neither Harmony Haven nor any of our employees, officers, directors, agents, nor any other party involved in creating, producing, or delivering the Site shall be liable to you or any third party for your use of, or the inability to use, the Site or its Content, except in cases of (1) gross negligence, recklessness, or intentional misconduct; or (2) a violation of a consumer protection statute related to the Site.
In no event shall Harmony Haven be liable for any indirect, incidental, special, or consequential damages of any kind, including, without limitation, those resulting from loss of use or profits, whether or not Harmony Haven has been advised of the possibility of such damages, arising out of or in connection with the use of the Site. Harmony Haven’s total cumulative liability in connection with these Terms of Use and the use of the Site, whether in contract or tort or otherwise, shall not exceed $1,000. Some jurisdictions do not allow the limitation or exclusion of liability for consequential or incidental damages, so the above limitation or exclusion may not apply to you.
Order Acceptance
All orders—whether online, by telephone, or as preorders for limited availability products—are not binding upon Harmony Haven until we accept them. Payment must be processed by Harmony Haven before an order is considered accepted, unless otherwise agreed upon. Harmony Haven will confirm acceptance of your order through an acknowledgment email, followed by processing your payment and shipping the item(s) ordered to you, or by processing your payment in-store and providing the item(s) ordered directly to you. We retain the right to decline providing products or services to anyone.
Pricing Information
Given the fast-changing nature of prices, product descriptions, and availability, Harmony Haven does not guarantee the accuracy or completeness of the information provided on the Site, in stores, or in written materials. We are not responsible for any pricing, typographical, or other errors.
If a product purchased does not match its description on the Site, your sole remedy is to return the product unused to Harmony Haven for a full refund of the purchase price.
Prices listed in your shopping cart reflect the most recent price displayed on the product’s detail page. Due to frequent updates for sales, limited-time pricing, and discounts, the prices in your cart and on the detail page may change after you add items. Placing items in your cart does not reserve the price shown at that moment. The price is only locked in when the order is placed.
In the case of a pricing error, Harmony Haven will handle it as follows: (1) if an item’s correct price is lower than the stated price, we will charge the lower amount and ship the item; or (2) if the correct price is higher, we will either contact you for instructions before shipping or cancel the order and notify you of the cancellation. We apologize for any inconvenience this may cause. If you are not satisfied with your purchase due to any errors, you can return it in accordance with our Return Policy.
List Price or Manufacturer’s Suggested Retail Price (MSRP) references in our materials are intended for informational purposes only and are supplied by the manufacturer. Harmony Haven often sells products at prices lower than the List Price/MSRP, and sales at List Price/MSRP are not guaranteed. The List Price/MSRP may vary by product, geographic location, and store type.
We make every effort to update List Prices/MSRPs in our printed materials and on the Site as new information becomes available. However, manufacturers may change List Prices/MSRPs without notifying us, so for the most current information, we recommend contacting the product’s manufacturer directly.
List Price/MSRP may also be quoted for house or private label brands, which we frequently sell at lower prices than suggested retail. This is based on comparable name-brand products, but sales at List Price/MSRP may not have occurred.
Our limited-time events are designed to offer temporary discounts, but these prices may remain valid beyond the event. The value of items labeled “free with purchase” is based on their regular selling price.
Limited Availability Products
Harmony Haven regularly offers vintage, special limited edition, and other limited-quantity items to the public. Due to their scarcity and high demand, these items are sold strictly on a “first come, first served” basis. Placing a preorder or crediting an account does not guarantee you will receive the product—it merely places you on a waiting list for that product.
We make every effort to fulfill preorders in the order they are received, along with any required deposit or credit, until all available products we decide to sell, in our sole discretion, have been sold. If you have placed a preorder and we are unable to fulfill your request due to limited availability, we will promptly refund any deposit or credit on account.
Limited Warranty
All new products are sold with the manufacturer's limited warranty. The warranty period and service varies by manufacturer and product. The full text of any such warranty is available, free of charge, upon written request addressed to: Harmony Haven Music Group LLC, ATTN: Warranty Request, 550 E Betteravia Rd, Ste D, Santa Maria, CA 93454
Repair Disclaimer
We are dedicated to making the repair process as straightforward as possible for our customers. Harmony Haven offers repair services through a variety of channels, including in-store repair facilities, offsite repairs at outside service centers, and occasionally referral to a local independent repair service. However, Harmony Haven accepts no responsibility for any loss or damage to customer-owned merchandise that is not directly caused by our repair work or handling.
Customers are fully responsible for all charges incurred, including but not limited to, freight to and from the repair service center, parts, labor, local taxes, handling fees, and any surcharge/estimated fees (if applicable). Merchandise that is not picked up (and paid for) within 90 days after we notify you of completed repairs using the contact information you provided will be considered abandoned by Harmony Haven.
Contests, Sweepstakes, and Promotions
From time to time, Harmony Haven may offer promotions on or through the Site, including but not limited to contests and sweepstakes (each, a “Promotion”). Each Promotion may have its own set of Official Rules or other specific terms and conditions, which will be posted or made available to you. These terms will be incorporated into and form part of these Terms of Use for the duration of that Promotion. In the event of any conflict between these Terms of Use and the terms for any Promotion, the terms specific to that Promotion will prevail.
